Eligibility case finds 'standing'? New suit claims unique state law enables citizens to demand proof

A new case challenging Barack Obama's natural-born citizenship
and, therefore, constitutional eligibility to serve as president has the potential to clear a hurdle that caused several other similar cases' dismissal: the issue of "standing."

In the case brought by Pennsylvania Democrat Philip Berg, for example, a federal judge ruled against the lawsuit in deciding Berg lacked the "standing" to sue, arguing that the election of Obama wouldn't cause the plaintiff specific, personal injury

In Washington state's Broe v. Reed case, however, plaintiff's attorney Stephen Pidgeon says a unique state statute grants everyday citizens the required standing.

"These lawsuits have pointed their fingers at the various secretaries of state and said, 'You handle the elections, it's your job [to verify Obama's eligibility],"Stephen Pidgeon told WND, "and the secretaries of state have said, 'No, it's not our job.
You the voter have to prove he was ineligible.' But when the voters try to do it, the courts tell them they have no standing. So it presents a catch-22.

"Here, we have standing by means of statute," Pidgeon continued. "This particular statute provides for any registered voter to challenge the election of a candidate if the candidate at the time of the election was ineligible to hold office."
Further, Pidgeon explained, "In Washington we also have a constitutional clause in Article 1 that says the U.S. Constitution is the supreme law of land, so it's very much a state issue that the secretary of state has a duty to enforce the U.S. Constitution.

"He doesn't think he does; we think he does. That's really the issue before the court," Pidgeon said.

Washington's secretary of state, Mr. Sam Reed, has opposed the lawsuit, brought by a group of 12 registered Washington voters with Pidgeon's representation, on several grounds, including the argument that the issue is moot now that Obama has been voted upon by the people.
Pidgeon argues, however, that even if Obama remains in office two years from now, the issue will not be moot.

"The Constitution's criteria for president are never moot," Pidgeon explained. "Article 2, Section 1 says 'eligible to the Office of President'; it doesn't say 'eligible for candidacy to the Office of President."
Therefore, Pidgeon argues, the Constitution's natural-born citizen clause specifically and expressly addresses the man sitting in the Oval Office, not just the main elected and waiting to get in.

"If, at any time during his tenure, a birth certificate actually surfaces showing [Obama] born in Kenya," Pidgeon said, "he is disqualified from the presidency at any time. And the constitutional crisis that is rising out of this – the longer he's in that office, the greater the problem becomes, because everything he does will be illegal."

The Washington Supreme Court is set to hear Broe v. Reed on Jan. 8, but the entire case may be delayed intentionally, as the plaintiffs wait to see if the court will rule first on a requested subpoena of Obama's birth certificate from Hawaii.

Unlike other states where lawsuits challenging Obama's natural-born citizen status were required to move through lower courts, Washington law grants the case "original jurisdiction" at the state Supreme Court, which means the plaintiff can present new evidence, including – if the court will indeed subpoena it – Obama's birth records.
"We have opportunity to present facts before the Supreme Court, where you wouldn't have that normally," Pidgeon told WND. "With original jurisdiction, we have the opportunity to present factual argument, and so what we have said to the court is, 'At no time did Senator Obama produce a single piece of evidence upon which the secretary of state could rely to establish that he was a natural born citizen, or that he was even an American citizen, or that he was running under his legal name.' Those are the three facets of our lawsuit."

Pidgeon also told WND that the case's primary hurdle now is the natural predisposition judges have toward complying with the democratic will of the people. They rarely "upset the apple cart," Pidgeon said, by overturning the results of an election.

Still, Pidgeon believes pursuing Broe v. Reed is necessary.
"I expect the truth of Senator Obama's birth is going to come out," Pidgeon told WND. "It may not be today, it may not be tomorrow, but the truth of his birth is going to come out, and when that true fact comes out that he was born in Kenya, we will have an unprecedented constitutional crisis in this nation.

"The question is," Pidgeon figures, "will the Washington Supreme Court stand for the rule of law or are they going to stand for an overthrow of the constitutional republic by the will of the electorate?"

Last month, WND reported on the potential complications an ineligible president could create.
"Should Senator Obama be discovered, after he takes office, to be ineligible for the Office of President of the United States of America and, thereby, his election declared void," argues a similar case brought by Alan Keyes and pending in California, "Americans will suffer irreparable harm in that (a) usurper will be sitting as the President of the United States, and none of the treaties, laws, or executive orders signed by him will be valid or legal."
The biggest question was why, if a Hawaii birth certificate exists as his campaign has stated, Obama hasn't simply ordered it made available to settle the rumors?
The governor's office in Hawaii said there is a valid certificate but rejected requests for access and left ambiguous its origin: Does the certificate on file with the Department of Health indicate a Hawaii birth or was it generated after the Obama family registered a Kenyan birth in Hawaii?

I don’t hear much about Hillary Clinton’s husband’s foundation, and about her conflict of interest in this foundation. You may say…..HEY AL….The Clinton Foundation’s is hardly the Arian nation. Let’s talk about that analogy for a minute. The Arian nation professes hate, primarily against blacks and Jews. The donors of the Clinton Foundation consists of the following:

It is common knowledge that the Governments of the Middle East clearly exhibit hatred for Israel, and have voiced so often.

President Clinton still wields extraordinary power and influence, and does in fact have total discretionary control of all these funds.

To assume that Hillary Clinton’s position would be totally unbiased in a primary mission for a lasting Middle East Peace would be naïve to say the least.

At least Todd Palin can jump on his snow machine this winter, and compete in his annual race without worry about disproportionate criticism toward him!

One of the irresponsible 43 Governors



New York's Gov. David Paterson has proposed a tax package that adds $4 billion to the state's already overburdened taxpayers. We suppose they get what they vote for. Paterson's aim is to close a budget deficit of $15 billion, and liberals naturally gravitate toward tax hikes rather than spending cuts. Funny how taxpayers don't get to apply the same principles to their own budgets...
Paterson's tax plan calls for 88 new fees and taxes, including a clothing tax, radio tax, cable TV tax, movie theater tax, sporting event tax, taxi tax, bus tax, limo tax, iPod tax, beer tax, cigar tax, massage tax, and even an 18-percent tax hike on soda and other sugary drinks containing less than 70 percent real fruit juice. Fees at state parks and the Department of Motor Vehicles also will be raised. The only tax that didn't see an increase, it seems, was the income tax. "We're going to have to take some extreme measures," Paterson said of the plan. "This is where we are," Paterson added. "Maybe we should have thought about this when we were depending on what we thought was inexhaustive collections of taxes from Wall Street -- and now those taxes have fallen off a cliff." Our nation's Founders fought a war over excessive taxes, declaring "no taxation without representation." Well, taxation with representation ain't so hot, either.

Politicians and Management of the Big 3 are both infected with the same entitlement mentality that has spread like cancerous germs in UAW halls for the last countless decades, and whose plague is now sweeping this nation, awaiting our new "messiah", Pres-elect Obama, to wave his magic wand and make all our problems go away, while at the same time allowing our once great nation to keep "living the dream"… Believe me folks, the dream is over!




This dream where we can ignore the consumer for years while management myopically focuses on its personal rewards packages at the same time that our factories have been filled with the worlds most overpaid, arrogant, ignorant and laziest entitlement minded "laborers" without paying the price for these atrocities…this dream where you still think the masses will line up to buy our products for ever and ever.


Don't even think about telling me I'm wrong. Don't accuse me of not knowing of what I speak. I have called on Ford, GM, Chrysler, TRW, Delphi, Kelsey Hayes, American Axle and countless other automotive OEM's throughout the Midwest during the past 30 years and
what I've seen over those years in these union shops can only
be described as disgusting.




Troy Clarke, President of General Motors North America, states: "There is widespread sentiment throughout this country, and our government, and especially via the news media, that the current crisis is completely the result of bad management which it certainly is not." You're right Mr. Clarke, it's not JUST management…
how about the electricians who walk around the plants like lords in feudal times, making people wait on them for countless hours while they drag ass…so they can come in on the weekend and make double and triple time…for a job they easily could have done within their normal 40 hour work week. How about the line workers who threaten newbies with all kinds of scare tactics…for putting out too many parts on a shift…and for being too productive (We certainly must not expose those lazy bums who have been getting overpaid for decades for their horrific underproduction, must we?!?)




Do you folks really not know about this stuff?!? How about this great sentiment abridged from Mr. Clarke's sad plea: "over the last few years …we have closed the quality and efficiency gaps with our competitors." What the hell has Detroit been doing for the last 40 years?!? Did we really JUST wake up to the gaps in quality and efficiency between us and them?



The K car vs. the Accord? The Pinto vs. the Civic?!? Do I need to go on? What a joke! We are living through the inevitable outcome of the actions of the United States auto industry for decades. It's time to pay for your sins, Detroit.




I attended an economic summit last week where brilliant economist, Alan Beaulieu, from the Institute of Trend Research, surprised the crowd when he said he would not have given the banks a penny of "bailout money". "Yes, he said, this would cause short term problems," but despite what people like politicians and corporate magnates would have us believe, the sun would in fact rise the next day… and the following very important thing would happen…where there had been greedy and sloppy banks, new efficient ones would pop up…that is how a free market system works…it does work…if we would only let it work…"




But for some nondescript reason we are now deciding that the rest of the world is right and that capitalism doesn't work - that we need the government to step in and "save us"…Save us my ass, Hell - we're nationalizing…and unfortunately too many of our once fine nation's citizens don't even have a clue that this is what is really happening…But, they sure can tell you the stats on their favorite sports teams…yeah - THAT'S really important, isn't it…




Does it ever occur to ANYONE that the "competition" has been producing vehicles, EXTREMELY PROFITABLY, for decades in this country?... How can that be??? Let's see… Fuel efficient… Listening to customers… Investing in the proper tooling and automation for the long haul… Not being too complacent or arrogant to listen to Dr. W. Edwards Deming four decades ago when he taught that by adopting appropriate principles of management, organizations could increase quality and simultaneously reduce costs. Ever increased productivity through quality and intelligent planning… Treating vendors like strategic partners, rather than like "the enemy"… Efficient front and back offices… Non union environment…




Again, I could go on and on, but I really wouldn't be telling anyone anything they really don't already know down deep in their hearts.



I have six children, so I am not unfamiliar with the concept of wanting someone to bail you out of a mess that you have gotten yourself into - my children do this on a weekly, if not daily basis, as I did when I was their age. I do for them what my parents did for me (one of their greatest gifts, by the way) - I make them stand on their own two feet and accept the consequences of their actions and work through it. Radical concept, huh… Am I there for them in the wings? Of course - but only until such time as they need to be fully on their own as adults.




I don't want to oversimplify a complex situation, but there certainly are unmistakable parallels here between the proper role of parenting and government. Detroit and the United States need to pay for their sins. Bad news people it's coming whether we like it or not. The newly elected Messiah really doesn't have a magic wand big enough to "make it all go away."




I laughed as I heard Obama "reeling it back in" almost immediately after the final vote count was tallied…"we really might not do it in a year…or in four…" Where the Hell was that kind of talk when he was RUNNING for office. Stop trying to put off the inevitable folks … That house in Florida really isn't worth $750,000… People who jump across a border really don't deserve free health care benefits… That job driving that forklift for the Big 3 really isn't worth $85,000 a year…




We really shouldn't allow Wal-Mart to stock their shelves with products acquired from a country that unfairly manipulates their currency and has the most atrocious human rights infractions on the face of the globe… That couple whose combined income is less than $50,000 really shouldn't be living in that $485,000 home… Let the market correct itself folks - it will. Yes it will be painful, but it's gonna' be painful either way, and the bright side of my proposal is that on the other side of it all, is a nation that appreciates what it has…and doesn't live beyond its means…and gets back to basics…and redevelops the patriotic work ethic that made it the greatest nation in the history of the world…and probably turns back to God.

Families tearfully put hope in clemency during last days

As president, George W. Bush has pardoned or commuted sentences for 32 drug dealers, 12 thieves, seven embezzlers, an arsonist, an armed bank robber and eight Thanksgiving turkeys, among others – but U.S. Border Patrol agents Ignacio Ramos and Jose Compean remain in prison this Christmas, praying for their release.

"It's pretty much salt in the wound," Ramos' wife, Monica, told WND. "But we have a lot of hope. My husband has quite a bit of faith, and we pray a lot. We are hoping the outpouring of support that we have here from people all over the nation is going to help us."


Ramos and Compean are serving 11- and 12-year prison sentences, respectively, for shooting at a fleeing illegal alien drug dealer while he smuggled nearly 750 pounds of marijuana across the border. They were convicted of assault, discharge of a weapon in the commission of a crime of violence, tampering with an official proceeding and deprivation of civil rights.


U.S. Attorney Johnny Sutton's office gave the smuggler, Osbaldo Aldrete-Davila, full immunity from prosecution for agreeing to serve as the government's star witness and testify against the border agents.


A ruling, from the 5th U.S. Circuit Court of appeals, affirmed all convictions except for tampering with an official proceeding, which it vacated and remanded for resentencing.

Another lonely Christmas
For the Ramos and Compean families, this time of year is often very emotional without Ignacio and Jose.

"We have six children involved," Monica said. "It's really difficult – especially right now during this holiday season. Holidays for us are very depressing."

She said the Ramos and Compean children, five boys and one girl, range in age from 2 to 15. Ramos' imprisonment has drastically altered his three children's lives.


"Four years later, the kids have really changed," she said. "Their father was a huge part of their everyday routines, from little-league baseball to hunting. A lot of the traditions that we've had during our holidays have just changed. There is not much tradition anymore because there's a big void in our family right now."


Ramos' children rarely get to see their father because Monica's visits have been restricted to a single weekday, when the children are in school.


"My husband is supposed to be eligible for extra visits, and they have denied me extra visits with him," she said.


Ramos was segregated from the general prison population after he was assaulted in a Yazoo City, Miss., federal penitentiary following an "America's Most Wanted" episode that detailed the agents' struggles.


"A couple of the inmates in general population on the night it aired recognized my husband on TV," Ramos said. "They approached him shortly after the airing right when it was time to go to sleep, and five illegals just beat him severely."


The agent suffered three herniated disks and a fractured shoulder from the assault.


Four days later, representatives from Washington, including Rep. Tom Tancredo, R-Colo., and other congressional staffers, went to visit him.


"They were absolutely floored with what they saw happen to my husband," his wife said.

Ramos served only four days in general population. He was placed in total solitary confinement after the attack, and within months he was relocated to the Phoenix Federal Correctional Institute so he could be closer to his family. The new prison was accommodating and allowed normal visitation privileges at first.

However, Monica said seeing her husband now "is like pulling teeth."
"He is not supposed to be under the punitive consequences of segregation, even though he's there," she said. "He is supposed to be eligible for any of the provisions that would be for any general population."


Tried and convicted by media

Monica said while her family is coping with her husband's confinement, her children often watch television and see media distortions about their father's case.

"It's sad to say that both men were tried in the eyes of the media," she said. "With the kids, I am very honest with them. I keep them very informed of what the truth is. I make sure that they realize that in the media they are going to hear differently – especially here in our media. We have very little support in El Paso."

Ramos said it is difficult to live in a border town known as the "sister city" to Juarez, Mexico, because many people automatically assume the agents are guilty.


"Being that we're so close to Mexico, there are a lot of people who have their roots in Mexico," she said. "This is why people started to say in the beginning that we are racist. I'm not racist. I think that there are very many people in Mexico that deserve a better chance at life here in the United States.

"But if you're going to come here, you're going to do it the right way," she said.
While some area residents automatically condemned the agents, Ramos said the media played on sensationalism for what they believed was a good story.


"What's more intriguing for a story: A drug dealer getting caught? That's an everyday thing here," she said. "Or two border patrol agents who supposedly covered it up?"

Appeal to U.S. Supreme Court
Ramos' attorney, David Botsworth, said a petition for writ of certiorari was filed with the U.S. Supreme Court and docketed on Dec. 11. The government has the right to file a response should it choose to do so by early January.

"It's obviously an astronomical uphill battle to get review in the Supreme Court," Botsworth said. "I think the issues are worthy of their consideration."

Asked whether he believes President Bush will wait to see whether the Supreme Court accepts the appeal, Botsford said, "He certainly didn't do that with Scooter Libby, did he?"

The agents may still file a motion to vacate sentence for one year if the Supreme Court denies certiorari.

Beyond those steps, the only other option is for the president to grant a pardon or commutation of sentence request filed through the U.S. Department of Justice Office of the Pardon Attorney.
WND's calls to the DOJ pardon attorney have not yet been returned.
Nonetheless, Ramos believes public pressure could make all the difference.

"So many people have seen the injustice in this," Ramos said. "People might say, 'What's my voice going to do?' Myself and Mrs. Compean, we're but one voice. We need the help of the public. We need people to help us contact him."


Her family continues to hope and pray that President Bush will intervene.
"We are guardedly optimistic that it will happen. We only have a few more weeks to work on the president in hopes that it touches his heart."

Justice Kennedy rejects 2 more challenges to Obama

WASHINGTON (AP) — Supreme Court Justice Anthony Kennedy has rejected two more efforts to get the court to consider whether President-elect Barack Obama is eligible to take office.
Kennedy on Wednesday denied without comment an appeal by Philip J. Berg, a Pennsylvania attorney, that claims Obama is either a citizen of Kenya or Indonesia and is ineligible to be president because he is not a "natural-born citizen" of the U.S. as required by the Constitution. Another appeal from California, based on Berg's claims, also was denied.
Individual justices and the entire court have turned down emergency appeals over Obama's eligibility at least seven times in the past six weeks.
Obama was born in Hawaii in 1961 to an American mother and a Kenyan father.
Reacting to Internet-fueled conspiracy theories that Obama's birth certificate is a fake, Hawaiian officials have said they examined the document and have no doubt it is authentic.

Cable television introduced us to "The Real Housewives of Orange County" -- an estrogen-infused reality show featuring a coven of conniving and ambitious women living pampered lives in Southern California. Blago-gate has brought us something even juicier: The Real Housewives of Crook County, Illinois.


The public may be wearying of indicted Democratic Gov. Rod Blagojevich and the Chicago boys' club, but the conniving and ambitious women behind the scenes of the corruption scandal are a must-see political drama all their own.


Mrs. Blago, the former Patti Mell, won the hearts of old-school thugs everywhere with her f-word-filled rants captured on FBI wiretaps, some of which were colorfully detailed in the criminal complaint against her hubby last week. It's old news to folks in Chicago, but the woman who masquerades as a sweet gubernatorial spouse dedicated to children's advocacy is a cutthroat wheeler-dealer in heels who schemed with the gov to fire pesky editorial writers and get herself placed on paid corporate boards in exchange for naming the president-elect's pick to the Senate. First Lady by day, Dragon Lady by night.

Potty-mouthed Patti is the daughter of famed Democratic Chicago Alderman Richard Mell. Hardball ward politics runs in her blood. "Pay to play" is the family way. As a high-powered realtor, the Chicago Tribune reported, Mrs. B. raked in more than $700,000 in commissions on business deals after Hot Rod began raising money in 2000 for his first gubernatorial campaign. The feds have been investigating for years.

Close political observers are waiting for the other shoe to drop on Mrs. B. -- or be used as leverage to force her hubby, to whom she has been fiercely loyal (to the point of alienating Daddy), to 'fess up.


Corrupto-convict and Barack Obama fundraiser Tony Rezko was one of Mrs. B.'s biggest clients of the last decade. Behind him stood his housewife-in-hot-water, Rita, who whiled away some of her time as a patronage appointee to an obscure Cook County government board before getting entangled in the land swap couples' deal between her husband and the Obamas -- the one the president-elect called "boneheaded."


On Tuesday, Rezko's sentencing was postponed, suggesting he'll be singing even more to the feds.


Michelle Obama was apparently friendly with the sordid sorority, according to Chicago Magazine. Writer James Merriner reported on a fashion show/political back-scratching gala chaired by Mrs. Rezko and co-chaired by Mrs. Blago two days before the November 2006 elections:
"Michelle Obama, wife of the Democratic U.S. senator and presidential candidate Barack Obama, was a special guest that day (even though the news had just broken about Rezko's participation in a funky real-estate transaction involving the Obamas' Hyde Park home).


The fashion show attracted little if any media coverage, which may have been exactly as its organizers and sponsors had hoped. Just three weeks earlier, Tony Rezko had been indicted on charges of extorting kickbacks from businesses seeking contracts from the Blagojevich administration."


Then there's Anita Mahajan, wife of Chicago Mutual Bank owner Amrish Mahajan. Hubby is the Obama supporter and Blago fundraiser who handled that boneheaded Obama land deal and loaned cash to Rezko. Mrs. Mahajan hired Mrs. Blago to sell properties for her. In 2007, Mrs. Mahajan was indicted on fraud charges related to a contract from the state Department of Children and Family Services -- awarded to her by the Blagojevich administration. Prosecutors say she bilked taxpayers out of $2.1 million. For the children, of course.

More Than 650 International Scientists Dissent Over Man-Made Global Warming Claims
Scientists Continue to Debunk “Consensus” in 2008


INTRODUCTION:
Over 650 dissenting scientists from around the globe challenged man-made global
warming claims made by the United Nations Intergovernmental Panel on Climate Change
(IPCC) and former Vice President Al Gore. This new 231-page U.S. Senate Minority
Report report -- updated from 2007’s groundbreaking report of over 400 scientists who
voiced skepticism about the so-called global warming “consensus” -- features the
skeptical voices of over 650 prominent international scientists, including many current

Editorial note;
Finally the scientific community has chosen to have their collective voices heard regardless of being "blackballed" by the UN or the Gore followers. The new administration wishes to adopt the Kyoto Protocol, regardless of the monetary hardships it encompasses.

This is the most important part you will read here. Most of the EU subscribed to the Protocol 4 years ago. The agreement states that they will not only hold firm any CO2 contaminants from the 2003 level, but to reduce them by certain percentages. TO THIS DAY NOT ONE HAS EVEN HELD THE LEVEL FIRM, let alone reduce it. The only thing it has served to do is to give the UN money by way of fines.

My Christmas Wish


My Christmas Wish

A friend of mine asked me the other day what I wanted for Christmas. Being in a sarcastically humorous mood, I responded "A Government Bailout". When he asked me what I seriously wanted, I started thinking about my original answer.

I have several real wishes for Christmas, May my kids, parents, wife and loved ones are safe and healthy throughout the year. May we live in peace this year and many more to come. May our troops be safe and treated with the respect they deserve and earned and be victorious in all their endeavors. May America truly once again become the land of the free and the home of the brave.

But..................

Why not a Government Bailout for Christmas. All the friends of the left got one: Citibank, AIG, Fannie and Freddie and the list goes on. After so much outcry from the public, the big three automakers are going to get one as well although they had to submit a plan for how they intend to spend the money.

How about those families that bit off way more than they could chew and bought nice $250,000.00 homes on less than $60,000 a year incomes and never dreamed that their Adjustable Rate Mortgages would ever actually go up. Too many foreclosures so now if you are late by three months or more in your house payment, you can negotiate your ARM into a fixed a rate that is less than someone with a 700 credit score and trying to buy a house with a fixed rate loan is going to get.

The big three automakers can't pay their debts, the CEO's of several financial and other types of institutions can't pay their debts, but why is it that a majority of the general public can? Most of us do not have economics degrees or degrees in accounting or business management, yet because most of us can actually manage our own financial matters. We are the only reason some of these companies are still afloat. We actually are responsible enough to pay our own debts.

Ever notice just how easy if was for Freddie, Fannie, AIG and the others to get their big fat checks from the government. Notice just how eager the government is to give the big three money under the pretense that they want full accounting of every dollar they are going to spend of taxpayer money. Now compare their treatment to the way the democratic controlled congress treated the oil company presidents. The oil companies make about 8 cents a gallon on gas, no matter if it cost $1.50 a gallon or $4.50 a gallon, their profit margin is the same. They are not bankrupt. They are operated quite efficiently and what did congress want to do to them, hit them with additional taxes just because they are successful.

Democrats in power now want one thing.....more power. They want the ability to control or manipulate everything in and about the market. The main reason they repeatedly roasted the oil company execs were because unlike the banks and the auto industry, they can't control or manipulate it. Then add to the fact that most of their CEO's do not contribute to democrats or the Democratic Party. So, we have a congress that rewards failure and punishes success.

So, instead of punishing success and rewarding failure, wouldn't our tax payer dollars be better used if it were given to those of us that have managed to pay our bills on time, didn't buy more house, car or whatever than we could afford and didn't max out credit cards.

So, here is my idea of what kind of government bailout I want for Christmas. No more corporate bailouts, this plan will eliminate any need for them. I want everyone who is current on all their bills to receive $300,000. $240,000 worth to come as a non-taxable vouchers from the government. This money can be used in various ways but a majority of it must be used in the following manner: 40% ($120,000) MUST go towards either the purchase of a new home or pay off an existing home loan. This would clear up all the housing crisis mess. If you owe less than $120,000 on an existing loan, the remaining balance of this portion must go back to the government to help reduce the national debt. 20% ($60,000) must go towards the purchase of a new vehicle or pay off any existing car loans or any combination of the two, but no auto loan can still exist afterwards. Any remaining amount from the $60,000 must go to help shore up a failing social security system and only to be used for that purpose. This will bail out the auto industry & help keep social security afloat without an immediate tax hike. An additional 20% is allowed to be put into a state ran college education savings plan for our children regardless of the amount of kids per household so long as there is at least one child per household under the age of 24 or used to pay off existing student loans including credit card purchases made for educational purposes. The last $60,000 issued in check form would be taxable and declared as reportable income. This could be used for any purpose we so desire. This would eliminate any need for any further stimulus packages or Wall Street bailouts because most Americans are going to spend that money for various things. I myself would spend all of it to have my kitchen and bathrooms totally gutted and updated.

Illinois Gov. Rod Blagojevich was arrested Tuesday on charges of conspiring to get financial benefits through his authority to appoint a U.S. senator to fill the vacancy left by Barack Obama's election as president.

It’s nice to see that the Illinois governor is keeping the reputation of having the most corrupt politics in the nation going.

He was charged with a federal criminal complain of illegally threatening to with holding assistance to the Chicago Tribune, the owner of the Chicago Tribune, on the sale of Wrigley Field, unless the owner fired certain members of the Editorial Staff who were critical of him.

This was only one of the charges contained in a 76 page affidavit from the FBI containing transcripts from court approved wire taps. He reportedly sought to sell or trade the senate seat left by Barack Obama.

He wanted to be appointed to a non-profit board of directors for a large salary, or a board of director’s seat in a labor union. He also wanted his wife appointed to something in the same manner for somewhere around $150k a year.

The affidavit says he was quoted as saying "I want to make money,"

Just yesterday in an appearance supporting the striking union at the Republic Window and Door, he taunted the Federal investigation, calling it something resembling “Water Gate.”

He was taken into federal custody this morning, apparently the Feds weren’t amused, even though Barack Obama endorsed him for a second term as Governor!

Is anyone surprised where we are?


Don’t get me wrong, I don’t support the big three auto manufacturers, and the archaic way they do business, but this is a calamity of stupid people making our lives miserable.

Look at this logically, only Ford, GM, and Chrysler are standing on the corner wanting money. Do we see Toyota or Honda with their hands out? We have talked about the cost of doing business in the past, but the big three have given concessions to the UAW that have crippled them on a profit basis. You can’t compare the big three’s cost basis of $71 per hour to Toyota’s cost of $46 per hour and expect things to be equal.

Now on the side of the big three….. Congress has mandated requirements of them to produce a product that THEY want. Congress has demanded hybrids, electrics, and alternate fueled cars. Retooling is an astronomical expense for just one model, not to mention the whole line.

I can see raising the CAFÉ (corporate average fuel economy), that gives the big three room to move and come up with a plan to accommodate the request, but to demand the types of vehicles to be produced is overstepping the Congress’s bounds.

Imagine you own a company that makes say…….cookies, the government tells you, yes they are great but the chocolate has too many calories, so you need to use artificial sweetener. The taste isn’t the same and thus sales drop off. As you struggle to regain the taste through a revamped recipe, the government comes to you and says that you have to phase out the cookies and start making figure friendly natural power bars that taste like a picnic bench. You are probably laughing, but this analogy isn’t far from the truth.

Our economy is based on Capitalism, we make what the public wants, and is willing to pay for. Government intervention in privately owned businesses, is economic socialism. The big question is……who picks the next company to control?

The very same people who claimed that Fannie Mae and Freddie Mac were solvent and in fine shape, are still making decisions with our money, Chris Dodd in the Senate, and Barney Frank in the House. Have they answered to anyone on the first bailout? As a result we are going on the hook for trillions more, because they don’t understand the basic principle of not spending more money then you have. We know how to set a budget in our own homes, so why don’t they? They do know, but it’s NOT their money, it’s OURS!

Where is the ethics committee? Isn’t this the group that judges the moral and ethical actions of Congress?

I read a statistic the other day that scared me to death…….50% of voters in our country don’t know the three bodies of government…..no wonder we can’t throw the jerks in government out, there are only 50% of the voting body who are informed, just one more reason we lag the world in education.

The deadline for the DNC and Barack Obama to reply to the writ of certiorari has passed as of December 3, 2008. December 1st plus two days for mail delivery. I was incorrect on previous posts when I said that Obama had been ordered to produce his birth certificate under this writ.

Philip Berg has said recently that he fully expected both Obama and the DNC to refuse to answer the writ, quite possibly to avoid a later charge of perjury if the certificate proved to be a forgery.

Today will be the deadline for the US Supreme Court to schedule the hearings for this month. If only 4 Supreme Court Justices decide they want to hear this case, it will schedule. Then and only then could the court order an actual birth certificate.

I did some 3 hours of investigation on the supposed “certificate of live birth” displayed on Obama’s Fight the Smears website. First I wanted to find out what the difference was between a certificate of live birth, and an actual birth certificate was. I’m not sure if Hawaii is different then all other states or not, but they claim in their website that the certificate of live birth isn’t a legal document, but the birth certificate is.

Now it is against the law to modify or alter a federal document used for identification purposes. Because the COLB isn’t a document, might be the reason the Obama Camp has presented it as proof that he was born here.

I have read other articles claiming that a COLB can be had by an application by the parents of the child on their say so of the date of birth even in another country.

I couldn’t find any information about under what circumstances Hawaii issues either document, only that the COLB isn’t a legal document.

So far Obama has spent half a million dollars to hire three law firms (not just lawyers), to defend himself on this action by Philip Berg. A Birth Certificate only costs $10 from Hawaii. You have to make the decision yourself on whether to believe Obama is battling this on a privacy standpoint, or on the idea he really doesn’t have a birth certificate. $500,000 on a principle seems pretty steep to me, but then again, I’m sure its using donor dollars anyway.

The problem here seems to stem from the constitutional requirement to be president. Although there is the requirement, there has never been a procedural system to submit such documents. This system of vetting should be in my opinion, done when the candidate first declares his/her run for POTUS. If nothing else comes from this, hopefully a system will be put into place before the next election.

If after the scheduling today for the December docket for the US Supreme Court, the Berg vs. Obama doesn’t appear, the question is basically dead. Of course if it isn’t heard, questions will surround the court about biased jurists.

If Obama goes through with his Inauguration while knowing his ineligibility for POTUS, he opens himself to a list of charges as long as his arm if the proof ever comes to light.

Here's another reason why people don't trust newspapers. When science reporters write about, say, hormone therapy or drinking red wine, they report on studies that find that hormones or red wine can be good for you, as well as studies that suggest otherwise.

Any science involving complex organisms is rarely black and white.
When it comes to global warming, newspapers play up stories that reinforce the prevalent the-sky-is-falling belief that global warming is human-caused and catastrophic. But if a study or scientist does not portend the end of the world as we know it, it rarely rates as news.

In that spirit, many papers (including The Chronicle) have reported on a UC San Diego science historian who reviewed 928 abstracts of peer-reviewed articles on global warming published between 1993 and 2003, and concluded, "Remarkably, none of the papers disagreed with the consensus position."

Over 10 years, not one study challenged the orthodoxy -- does that sound right to you? If that were true, it would strongly suggest that, despite conflicting evidence in this wide and changing world, no scientist dares challenge the politically correct position on the issue.

No wonder, David Bellamy -- an Australian botanist who was involved in some 400 TV productions, only to see his TV career go south after he questioned global warming orthodoxy -- wrote in The Australian last week, "It's not even science anymore; it's anti-science."

Bellamy notes that official data show that "in every year since 1998, world temperatures have been getting colder, and in 2002 Arctic ice actually increased."

Exhibit B: Richard S. Lindzen, the MIT Alfred P. Sloan Professor of Atmospheric Sciences, recently wrote, "There has been no warming since 1997 and no statistically significant warming since 1995."

Such findings rarely are reported, even as, Marc Morano, communications director for the Republicans on the Senate Environment and Public Works Committee told me, "Scientists keep coming out of the woodwork" to challenge the so-called consensus. "It's almost like a bandwagon effect."

The Global Warming Petition Project urges Washington to reject the Kyoto international global warming pact as there is "no convincing scientific evidence that human release of carbon dioxide, methane, or other greenhouse gases is causing or will, in the foreseeable future, cause catastrophic heating of the Earth's atmosphere and disruption of the Earth's climate."

So far,The Politico reports, more than 31,000 scientists have signed it.

The latest skirmish in the global warming war -- barely reported in America -- occurred after two bloggers found that the NASA Goddard Institute for Space Studies data wrongly cast this October as the warmest in recorded history.

It turns out that the mistake was due to an error that wrongly tapped September temperature records from Russia. Christopher Booker of The Sunday Telegraph of London found the mistake "startling" in light of other contrary climate statistics, including National Oceanic and Atmospheric Administration findings of 63 local snowfall records and 115 lowest-ever temperatures for the month.

In an e-mail, Goddard researcher Gavin Schmidt explained, "The incorrect analysis was online for less than 24 hours." (Thank bloggers Anthony Watts, an American meteorologist, and Canadian computer analyst Steve McIntyre for catching the mistake.)

The error occurred because a report "had the wrong month label attached. There is quality control at NOAA and GISS but this particular problem had not been noticed before and the existing QC procedures didn't catch it. These have now been amended."

As for the snowfall records and low temperatures cited by Booker, Schmidt chalked them up to "cherry picking" data. He added, "Far more important are the long-term trends."

Now, honest mistakes happen -- even in high-powered, well-funded research facilities. Just last year -- again thanks to the vigilance of Watts and McIntyre -- Goddard had to reconfigure its findings and recognize 1934 -- not 1998, as it had figured -- as the hottest year on record in American history.

Alas, it is hard to see Goddard as objective when its director, James Hansen, testified in a London court in September in support of six eco-vandals. A jury then acquitted the six Greenpeace activists on charges of vandalizing a British coal-fired power plant based on the "lawful excuse" defense that their use of force would prevent greater damage to the environment after Hansen predicted the one Kingsnorth plant could push "400 species" into extinction.

Of course, he could be wrong.

I’m curious as to what you believe about “record oil companies profits.”

Do you believe what the left mainstream media tells you? Do you believe what the Senators and Congressman tell you about how “windfall profits” need to be taxed?

Do you believe that oil companies make the most profit on each gallon of gas? Do you believe the gas station owner makes most of the profits? Do you think that OPEC makes the majority of the money?

Hopefully this explanation will make things a little clearer.

Let’s start with what gasoline costs to make. The latest data available of course is outdated already with the recent drop in price per barrel of crude, but you will get the percentage idea.




As you can see, the bulk of the cost is in crude product, other wise known as OPEC profit. The next largest cost is distribution and marketing. Because the cost of crude went up so does transportation, by way of diesel costs (oil companies pay that increase too.) Transportation also includes transportation to refineries by way of ship or pipelines. A note on refineries…..we don’t have enough of them in our country to even refine the crude we produce in OUR country. The eco left has prevented that, it has not been the choice that the oil companies have made, and contrary to what the media wants you to believe.

Taxes amount to 13% of the product only, and later you will understand this term a little better. Finally 3% of the cost is from refining.

What the public doesn’t understand is this is from the production standpoint. These prices and percentages get it into the tanks at the gas station only. This is where the tax on tax idea comes to light. NOW we add the federal tax of 18.4 cents a gallon and an average of 29.2 cents per gallon from the states. It also needs to be said at this point that diesel fuel is taxed more per gallon on the federal side…….6 cents more per gallon! The government has lamely supported this extra tax on the lower sulfur content of the new diesel, even though the oil companies have to absorb that extra refining in their profits.

The left media screamed about the record sales Exxon-Mobil made in the third quarter this year. The figure was $14.8 billion, but what the uninformed don’t see is the operating costs involved. Exxon is taxed at a 43.3% rate, yes you read that correctly. In this same 3rd quarter they paid $11.3 billion in income tax, they paid $9.3 billion in sales tax. They paid $11.85 billion in other taxes, for a grand total of $32.51 billion for the third quarter of 2008.

You may ask now “how do they stay in business?” This is a good question. In this current business era, where we bailout financial institutions, brokerages, and now talk about bailing out auto companies. If because of the falling cost of crude oil continues and lower profits are on the horizon for them, will they be eligible? Why is it that Congress thinks they have the right to bastardize the oil industry, while collecting more profits from them then they are allowed to keep? They tend to pick and chose those industries in the private sector, that THEY deem worthy of OUR money.

I explain all these things to you, because there is a rumor floating around about raising gas taxes because the gasoline prices have fallen. Congress has never been known to let the economy get in the way of a good windfall profit for them, and this seems to be no exception.

I have included an open letter to Congress, that I hope you will cut and paste and send to your respective representatives to hopefully halt this talk of raised taxes on fuel.

I am deeply concerned with talk of increased taxes on gasoline and diesel fuels. We already pay a federal tax of 18.4 cents per gallon on gasoline and 24.4 cents for diesel. The very idea that diesel is 6 cents per gallon higher is detrimental to inflation, as most products in America are transported by diesel powered carriers. I feel that diesel tax should be lowered to the same tax of 18.4 as gasoline.

Talk of increasing the taxes to 40 cents through incremental increases is unacceptable. You already tax the oil companies to an extreme amount, keeping more money then they may keep in profits. Now you want to tax us on TOP of them, double taxation. When the economy recovers, (and it will,) the price of gasoline will increase, and we will be stuck with your tax increase regardless of the horrendous effect it will have on the average citizen. (We know you don’t give up taxes easily.)
